Si Franz Kafka viviera, encontraría en Capilla del Señor el argumento indicado para reescribir buena parte de su obra. Mientras que, a Joseph K, en "El Proceso", lo investigan y condenan por un delito que nunca se conoce, en esta histórica ciudad, situada a 87 kilómetros de Buenos Aires, desde hace ocho años duerme tranquila unadenunciade la que todos hablan, pero nadie investiga.
El ex intendente de esta localidad Adalberto Aner (UCR) y el ex juez de Paz Martín Faure están denunciados por haberse supuestamente apropiado en forma ilegal de, por lo menos, 65 terrenos de la zona. Pero los dos están tranquilos y negaron a La Nación estar preocupados por las acusaciones en su contra.
El 22 de noviembre de 1999, la Suprema Corte de Justicia bonaerense finalizó un informe que presuntamente los compromete: los auditores judiciales descubrieron numerosas irregularidades en la aprobación de títulos de dominio tramitadas por Aner en el juzgado de Faure.
Con ese informe en mano, la Fiscalía Nº 6 de Zárate-Campana solicitó ante el Juzgado de Transición Nº 2, a cargo de Raquel Eslotolow, que se investigue por el delito de asociación ilícita a ambos ex funcionarios.
Según explicó a La Nación , el fiscal del caso, José Castaño, "en el juzgado de Faure se habrían cometido severas irregularidades en todos los juicios de usucapión presentados por Aner".
La usucapión, explicaron fuentes judiciales, es una figura legal que permite a cualquier persona adquirir un terreno si demuestra que lo ha poseído por más de 20 años.
El expediente, que en abril último tomó impulso con el pedido del fiscal Castaño se inició en 1992, cuando el abogado Gabriel Domenech denunció la maniobra.
Trámite inusual
El trámite del sumario no fue un trámite ordinario. Durante todos esos años, según constancias judiciales a las que accedió La Nación , la causa no hizo más que deambular por los diferentes juzgados de Zárate-Campana. Por algún motivo u otro, todos los jueces en los que recayó el expediente optaron por excusarse.
"Vos escribí lo que quieras, igual a mí nadie me va a investigar", dijo Aner en diálogo telefónico con La Nación .
Con la voz firme y, por momentos amenazante, agregó: "¿Quién te pensás que creó el juzgado de Zárate-Campana? La causa ya pasó por Pensotti, Boero Mansilla, y ahora no sé quién la tiene, pero está todo parado. Yo soy muy respetado y todos me tienen aprecio, así que no sé quién me va querer investigar".
Al ser consultado, el ex juez Martín Faure, más moderado y cauteloso se defendió. "A mí la Procuración me otorgó la jubilación. Es decir que, al parecer, no encontraron ninguna irregularidad en mi mandato. Ahora hay que esperar y ver lo que dice la Justicia."
El informe
Falta de pruebas, testimonios llamativos y una serie de indicios que harían pensar enuna profunda relación entre el estudio jurídico Aner y el juzgado de Faure, son algunas de las conclusiones del informe del máximo tribunal provincial.
En total se analizaron 65 de las 117 causas que, desde 1987 hasta 1999, tramitaron ante Faure. En todas ellas se encontraron supuestamente un sinfín de irregularidades.
Según el informe de la Corte:
En el 80% de los expedientes analizados no se presentó ningún tipo de comprobantes de pagos de impuestos, tasas o contribuciones aportados por los actores que decían ocupar el terreno. Esas son pruebas fundamentales en e ste tipo de causas.
En la mayoría de los casos, los testigos presentados por Aner son empleados municipales jerárquicamente subordinados. Un tercio de los casos fue iniciado cuando Aner era intendente.
Todos los funcionarios testificaron en reiteradas ocasiones en diferentes causas. El inspector de caminos municipal Alberto Milán declaró en 31 expedientes; el secretario de Gobierno Oscar Ponti participó en 26; el secretario de Hacienda y hermano de Aner,Hernán Aner, testificó en 23 expedientes, y el agente municipal Rodolfo De Feo lo hizo en 14 oportunidades.
Algunos de los testigos actuaron como actores en otras causas. Incluso el propio Aner resulta actor en uno de los procesos.
Los interrogatorios realizados a los testigos contienen preguntas formuladas en sentido indicativo que expresan o sugieren las respuestas.
En muchos casos, las respuestas de los testigos, aún los que deponen en días distintos, son similares o idénticas.
En la mayoría de las causas no se agotan las instancias para ubicar a los demandados y se designa por sorteo a una defensora oficial.
En 12 de los 65 expedientes analizados se designa a la defensora Delia Saavedra. Ella fue asesora legal y secretaria técnica de la municipalidad durante la gestión de Aner como intendente y, al mismo tiempo, socia del Estudio Aner.
"A simple vista",varios de los escritos redactados por la defensora Saavedra parecerían haber sido elaborados con la misma máquina de escribir en la que Aner redactaba las demandas. Esto llevaría a pensar que Saavedra utilizaba la infraestructura del Estudio Aner para trabajar y defender las causas promovidas por aquél.
Por último, se destaca el hecho de que en todos los juicios en los que se le solicitó al municipio que informara si tenía alguna pretensión sobre los terrenos en cuestión, éste -siempre con la firma de Aner o de su secretario Ponti- procedió allanándose al pedido.Esto significa que, a pesar de poder y estar capacitado para reclamar los terrenos, nunca lo hizo.
Después de elaborar el informe, y verificar varias de las irregularidades denunciadas por Domenech, la Corte instó a los jueces a investigar.
Tal decisión -la de seguir con la causa anterior y no iniciar una nueva- fue interpretada por ciertas fuentes del departamento judicial de Zárate-Campana como un llamado de atención a todos aquellos magistrados que tuvieron la causa en sus despachos.
Un político con fama de caudillo
En Capilla del Señor, Adalberto Aner tiene fama de caudillo. Entre los vecinos del pueblo, su nombre genera admiración para algunos y rechazo para otros.
Radical desde siempre, fue elegido intendente en dos períodos consecutivos (1983-1991). Algunos lo recuerdan como un buen orador y una persona de gran carisma. Otros, sin embargo, relatan historias de supuestas amenazas y la existencia de "una gran comitiva de protegidos dentro del municipio".
Todos le reconocen su habilidad para moverse en el terreno de la política. Y algunos lo caracterizan como un "político de esos que saben moverse".
"Si te quiere te ayuda, pero si no te quiere...", suele ser la frase más repetida entre los vecinos.
En carne propia
Luciano Streteimberger, un lugareño al que Aner le tramitó el trámite de usucapión, contó su experiencia a La Nación : "Me hace acordar a los caudillos de antaño. Aunque petiso, el tipo siempre va derecho, con la cabeza para arriba y el poncho doblado en el pecho.
"Es un tipo que se las conoce todas. Acá en el pueblo se habla mucho: de amenazas, arreglos, de todo. La verdad es que yo no lo invitaría a cenar".
A Streteimberger todavía se le nota la bronca: "Para que te des una idea de cómo y hasta dónde manejaba todo, te voy a contar una historia real. Una vez, la mano derecha de él, el comisario que patrullaba en la calle, mató a su mujer, pero a los tres días el tipo estaba afuera de nuevo, como si nada hubiera pasado", relató.
Hoy, Aner ya no cuenta con la estructura de poder que ostentaba cuando fue intendente. Trabaja en su estudio jurídico desde que dejó su cargo.
A medida que pasó el tiempo, los vecinos comenzaron a olvidar su figura y, también, su gestión municipal.
Al menos así lo demuestra el último puesto que obtuvo su hijo en las últimas elecciones por la intendencia de esta pequeña ciudad.

Adverse Possession, judicial sources explained, is a legal instrument that allows anyone to purchase land if he proves that he has owned for over 20 years.
The file, which picked up momentum last April with the prosecutor's request Castano began in 1992 when Gabriel Domenech lawyer denounced the move.
Unusual Step

The report
Lack of evidence, testimony and striking a number of indications that would suggest ina deep relationship between the law firm and court Aner Faure, are some of the conclusions of the report of the provincial high court.
A total of 65 of the 117 analyzed cases that, from 1987 to 1999, processed at Faure. They all allegedly found a host of irregularities.
According to the report of the Court:
In 80% of the cases examined did not show any proof of payment of taxes or contributions provided by the actors who occupy the ground said. These are key evidence and his type of causes.

In 12 of the 65 cases examined defender is appointed Delia Saavedra. She was general counsel and secretary of the municipality technique for the management of Aner as mayor and at the same time, a member of the Study Aner.

"If you want to help you, but if you want ...", the phrase most often repeated among the neighbors.
Firsthand
Streteimberger Luciano, a local who will Aner handled the processing of Adverse Possession, recounted his experience at The Nation: "reminds me of old warlords. Although Shorty, the guy always goes straight, head up and folded poncho in the chest.
